Current Bill Summary

SB 554 - This act prohibits persons from disclosing another's health information unless that person has authorized its release in writing. This act does not apply to the following areas:

1) Statistical data (without reference to the individual's identity);

2) Health research conducted pursuant to federal rules;

3) Information required to be released by law;

4) Release of information in emergency circumstances;

5) Release of information for body identification;

6) Release of information in connection with providing health care services to the person to whom the information pertains; and

7) The release of information by an insurance licensee for certain enumerated purposes.

Any person who violates this act is subject to a $500 fine and may be liable for civil damages. Insurance licensees that violate this act are subject to the provisions of the unfair trade practice law.

This act is similar to HS/HB 891 (2001).
